The Federal Circuit Court of Appeals Renders Decision in the Appeal by Kaneka Corporation in the U.S. Patent Infringement Lawsuit Relating to Oxidized Coenzyme Q10

On June 10, 2015, the Federal Circuit Court of Appeals ruled that the claim construction definitions determined by the District Court in granting its summary judgment was erroneous, vacated the judgment, and remanded the case to the District Court.
Not only are the new claim construction definitions binding on the California District Court, but also on the U.S. District Court for the Southern District of Texas, where Kaneka is in dispute with Zhejiang Medicine Co. Ltd. and ZMC-USA, LLC. in an infringement action for the same patent. As a result of this decision, Kaneka intends to proceed to a jury trial with the case in Texas and to the discovery process with the case in California.
